শর্তাবলী

1. শর্তাবলী গ্রহণ

সেম কেয়ারের ওয়েবসাইট বা পরিষেবাগুলির কোনও অংশ অ্যাক্সেস বা ব্যবহার করে, আপনি এই নিয়ম ও শর্তাবলী দ্বারা আবদ্ধ হতে সম্মত হন। আপনি যদি এই শর্তাবলীর কোন অংশের সাথে একমত না হন তবে আপনাকে আমাদের প্ল্যাটফর্ম ব্যবহার করার অনুমতি দেওয়া হবে না।

2. যোগ্যতা

সেম কেয়ার 18 বছর বা তার বেশি বয়সী ব্যক্তিদের জন্য ডিজাইন করা হয়েছে। আপনার বয়স 18 বছরের কম হলে, আপনি শুধুমাত্র পিতামাতা বা আইনি অভিভাবকের সম্মতিতে আমাদের পরিষেবাগুলি ব্যবহার করতে পারেন।

3. পরিষেবা দেওয়া হয়

• সার্চ ইঞ্জিন: চিকিৎসা তথ্য, ওষুধ এবং স্বাস্থ্য সম্পদের একটি ব্যাপক ডাটাবেস অন্বেষণ করুন।
• এআই প্রশ্ন ও উত্তর প্রজন্ম: আমাদের উন্নত এআই সিস্টেম থেকে আপনার স্বাস্থ্য সংক্রান্ত প্রশ্নের সঠিক, বিজ্ঞান-সমর্থিত উত্তর পান।
• মেডিকেল স্টোর: আশেপাশের ফার্মেসিগুলি সন্ধান করুন এবং সহজেই প্রয়োজনীয় ওষুধগুলি সন্ধান করুন৷
• ডাক্তার খুঁজুন: আপনার অবস্থান এবং স্বাস্থ্যসেবা চাহিদার উপর ভিত্তি করে যোগ্য স্বাস্থ্যসেবা পেশাদারদের খুঁজুন।
• হাসপাতাল খুঁজুন: যত্নের বিভিন্ন ক্ষেত্রে বিশেষজ্ঞ হাসপাতাল এবং ক্লিনিকগুলির একটি ডিরেক্টরি অ্যাক্সেস করুন।
• ওষুধ: প্রেসক্রিপশন ওষুধ, তাদের ব্যবহার, পার্শ্ব প্রতিক্রিয়া এবং মিথস্ক্রিয়া সম্পর্কে জানুন।

4. Medicine Orders

4.1 Purchaser eligibility

These provisions apply to medicine purchases; subscription provisions apply separately. You must be ordering for yourself or be authorized to order for the patient. When ordering for a child or another person who needs assistance, obtain the appropriate parent, guardian or caregiver authorization. The account eligibility and parent or guardian consent requirements in section 2 also apply.

4.2 Medicines and prescriptions

We follow Bangladesh medicine-sale requirements, including section 40(d) of the Drugs and Cosmetics Act 2023: non-OTC medicines, including antibiotics, require a registered medical practitioner's prescription. OTC classification depends on the exact medicine and formulation; unclassified medicines require prescription review on our platform. Restricted medicines are not available for online ordering. Read the official Act.

4.3 Pharmacist review

You must provide an authentic, readable and complete prescription applicable to the patient and medicines ordered. A qualified pharmacist checks the prescriber, patient, prescription date, medicine, strength, instructions and quantity. Payment or image upload does not guarantee prescription approval or dispensing. We may request clearer images or clarification, or decline an order that cannot safely or lawfully be fulfilled. Do not alter a prescription. Replacing it requires a new review. Prescription approval applies only to that order and does not authorize unlimited repeats.

4.4 Payment at checkout

Payment is required when placing an order. Your transaction reference is checked against the payment provider's records; entering a reference alone does not verify payment. Prescription approval and payment verification are separate checks. Do not send a second payment when retrying checkout or replacing a prescription. If you paid and checkout fails, retain the transaction reference and contact support if the order is missing.

4.5 Fulfilment and cancellation

Prescription orders remain on hold until approved. We do not automatically substitute medicines or change prescribed doses or quantities. If a change is needed, contact support; an incorrect order must be cancelled and reconciled before a corrected order is placed. Cancellation or rejection of a prepaid order triggers payment reconciliation and the refund process. Delivery estimates are not guarantees; applicable statutory delivery and refund obligations still apply. We will not dispatch restricted medicines or medicines requiring transport conditions that the delivery service cannot meet.

4.6 Support and consumer rights

This service is not emergency care or a substitute for medical advice. Contact support@care.sammx.com for order, prescription, cancellation or payment issues. The medicine-specific Refund Policy governs medicine refunds and takes precedence over subscription-only refund exclusions. Nothing in these terms excludes rights or remedies provided by Bangladesh law.

5. User Content and Conduct

You retain all rights to the content you submit (queries, reviews, etc.). By submitting public content, you grant Samm Care a non-exclusive, royalty-free license to use, modify, and publish that public content. This publication license does not apply to prescriptions, private medical records, payment information or private order data; their use is limited to the purposes in our Privacy Policy. আপনি অবৈধ, আপত্তিকর, বা ক্ষতিকারক কোন বিষয়বস্তু জমা দিতে হবে না.

6. Information Accuracy

যদিও আমরা সঠিক এবং আপ-টু-ডেট তথ্য প্রদানের চেষ্টা করি, ত্রুটি ঘটতে পারে। আপনি স্বীকার করছেন যে আপনি নিজের ঝুঁকিতে আমাদের পরিষেবাগুলি ব্যবহার করছেন এবং আপনার নিজের রায়ের উপর ভিত্তি করে স্বাস্থ্য সংক্রান্ত সিদ্ধান্ত নেওয়া উচিত।

7. Disclaimer of Warranties

Samm Care's services are provided "as is" without warranties of any kind, whether express or implied. We do not guarantee the accuracy, completeness, or reliability of the information presented.

8. Limitation of Liability

আমাদের পরিষেবাগুলি আপনার ব্যবহার থেকে উদ্ভূত কোনো প্রত্যক্ষ, পরোক্ষ, আনুষঙ্গিক, বিশেষ বা ফলস্বরূপ ক্ষতির জন্য সেম কেয়ার দায়বদ্ধ থাকবে না। এর মধ্যে ডেটা হারানো, লাভ, বা ব্যবসায়িক বাধার জন্য ক্ষতি অন্তর্ভুক্ত, কিন্তু সীমাবদ্ধ নয়।

9. Intellectual Property

সেম কেয়ারের ওয়েবসাইট এবং পরিষেবাগুলির সাথে সম্পর্কিত সমস্ত মেধা সম্পত্তি অধিকার আমাদের মালিকানাধীন৷ আপনি স্পষ্ট লিখিত অনুমতি ছাড়া আমাদের সামগ্রীর কোনো অংশ অনুলিপি, পরিবর্তন, বিতরণ বা শোষণ করতে পারবেন না।

10. Termination

সেম কেয়ার যে কোন সময়, যে কোন কারণে, এবং পূর্ব বিজ্ঞপ্তি ছাড়াই আমাদের পরিষেবাগুলিতে আপনার অ্যাক্সেস বন্ধ করার অধিকার সংরক্ষণ করে।

11. Governing Law

এই নিয়ম ও শর্তাবলী বাংলাদেশের আইন অনুসারে পরিচালিত হবে এবং বোঝানো হবে। এই শর্তাবলী থেকে উদ্ভূত বা সম্পর্কিত যে কোন বিরোধ বাংলাদেশের আদালতে সমাধান করা হবে।
